In addition to the items listed below, commission specific terms and conditions will be detailed in the booking confirmation and invoice.

A. General

1. In the following terms and conditions, ‘the photographer’ refers to Nigel Roake, trading as ‘Nigel Roake Digital Media’.
2. All agreements, contracts and sales shall be governed under English law.
3. Nigel Roake (the photographer) retains full copyright in all images, at all times, throughout the world, in accordance with the Copyright, Designs and Patents Act 1988.
4. The photographer asserts his right to be identified as the author of all images, by use of the words ‘Photographs by Nigel Roake’.
5. Payment for stock prints purchased online or in person must be completed at the time of purchase.
6. Products will not be dispatched until payment has been received by ‘Nigel Roake Digital Media’.
7. In all other instances, payment should be received by ‘Nigel Roake Digital Media’ no later than 30 days from the date of invoice.
8. Invoices not paid by the end of the 30th day from the invoice date will incur a 5% per day late fee.
9. Payments may be made using cash. Debit/ credit card payments may be made via iZettle secure payment link, which will be supplied by 'Nigel Roake Digital Media'. Payment options will be detailed in our invoice.
10. Cheques are not accepted.
11. These terms and conditions shall not be varied without written agreement.

B. Website ~ Copyright
For the purpose of the terms and conditions, ‘the website’ refers to ‘www.nigelroake.co.uk’ including all folders, directories, text, graphics, logos and images therein included and/ or displayed.

1. The text and images contained within the website belong to Nigel Roake Digital Media and are protected by copyright and other intellectual property rights.
2. No part of the website may be reproduced anywhere in any form without written permission from Nigel Roake Digital Media.

C. Data Protection

1. Security of personal and financial data is very important.
2. Data Protection Act (2018) and GDPR guidelines are followed.
3. Personal details are stored securely and will never be passed to 3rd parties without your express written consent.
4. Financial information is only used to process a transaction and is never stored once a transaction is completed.

D. Rejection

1. Photography, by its very nature is a creative and subjective medium.
2. All images will be produced to the highest possible quality, both technically and artistically according to the brief supplied by the client.
3. Unless a rejection fee has been agreed in advance, there is no right to reject on the basis of style, composition or editing.

F. Cancellation in respect of sections G, H, I, & J below

1. The client will complete a booking form. Nigel Roake Digital Media will send a confirmation of the booking via email. At this point, the booking will be deemed to be confirmed.
2. Once a booking is confirmed for a specific date and/ or time, other clients will not be able to book the same dates and/or times.
3. If the client wishes to cancel the booking, the following schedule of cancellation charges will apply:
   1. More than three weeks in advance, 10% of the agreed fee.
   2. During the second or third week in advance, 20% of the agreed fee.
   3. Within a week of the booking date, 30% of the agreed fee.
   4. On the day of the booking, 60% of the agreed fee.
4. In the event of adverse weather and or lighting conditions or other conditions beyond the control of the photographer, every reasonable step will be taken by Nigel Roake Digital Media to re-schedule a booking to a mutually acceptable time. Nigel Roake Digital Media reserves the right not to offer an alternative date and/ or time. If the client is unable or unwilling to agree a new booking date/ time with the photographer within a reasonable timescale and in any event not within one calendar month, 50% of the booking fee will be payable by the client to Nigel Roake Digital Media.

G. Headshots & Portraits (Actor/ Musician/ Corporate/ Individual/ Group Photographs)

I. Commissions for Landscape, Nature, Property and Product Photography

J. Bookings for photographic artworks to be displayed in 3rd party Exhibitions
These are in addition to the ‘General’ terms & conditions listed above.

1. Requests should be made to ‘Nigel Roake Digital Media’ no later than two weeks prior to intended exhibition start-date.
2. The fee for photographic artwork display is £100 per image per week or part thereof.
3. Transportation of photographic artworks to and from exhibitions will be at the exhibition organisers’ expense.
4. Transportation and hire costs will be confirmed by ‘Nigel Roake Digital Media’ prior to agreements being signed.
5. Information on each image as well as background information on the photographer will be displayed with each image. This will include display of the photographer’s website URL.
6. Photographic artwork prints sold at the exhibition will be priced by Nigel Roake Digital Media.
7. Sales made at the exhibition venue will include a 20% commission payable by ‘Nigel Roake Digital Media’ to the exhibition organiser.
